Contest Rules

These official rules govern the "Coat a Day Sweepstakes" (Sweepstakes"), which is offered by Comark Inc. ("Sponsor")

1. Sponsor
   The sponsor of this contest is Comark Inc., having offices at 6789 Millcreek Dr., Mississauga Ontario L5N 5M4 (the "Sponsor").
2. Sweepstakes Period
   Sweepstakes begins at 12:01am, EST, on October 14, 2011, and ends at 11:59pm, PST on November 6, 2011 (the "Sweepstakes Period"). All entries must be received prior to the end of the Sweepstakes Period.
3. To Enter
   There are two ways to enter: i) Visit www.rickis.com (the "Sweepstakes Site") to complete and submit the "Official rickis.com Electronic Entry Form", which will be available at the Sweepstakes Site during the Sweepstakes Period. Entries on www.rickis.com are limited to one electronic entry per customer per day for the duration of the Sweepstakes Period. Mechanically duplicated or automated entries are not permitted. No purchase is required. All Qualifying Entries will be entered in a daily draw for one chance to win a coat valid at any Ricki's retail location or online. All entries become the property of the Sponsor and will not be returned. ii) Visit the official Ricki's facebook page (the "Coat a Day Contest" page) to complete and submit the "Official Facebook Electronic Entry Form", which will be available at the Coat a Day Contest page during the Sweepstakes Period. Entries on the official Ricki's facebook page are limited to one electronic entry per customer per day for the duration of the Sweepstakes Period. One additional entry per day may be obtained by using the "Share with Friends" facebook option after the electronic form is filled out in order to gain one additional entry per day for the duration of the Sweepstakes Period. Mechanically duplicated or automated entries are not permitted. No purchase is required. All Qualifying Entries will be entered in a daily draw for one coat valid at any Ricki's retail location or online. All entries become the property of the Sponsor and will not be returned.
4. Administration
   Entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. In case of any doubt as to identification of entrant, the natural person who owns the email address utilized to enter shall be deemed to be the entrant. Sponsor, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or otherwise in violation of the rules. Sponsor further reserves the right to cancel, terminate or modify any promotion not capable of completion as planned, including by tampering, unauthorized intervention or force majeure. By entering, each entrant confirms (or as to entrants who are minors in the jurisdiction in which they reside, their parents/legal guardians confirm) having read these Official Rules and agrees that s/he understands and will comply with them, and attests to being over eighteen (18) years of age at time of entry. To the extent permitted by law, participation constitutes consent, without further compensation or approval, to use of entrant's name, likeness and/or biographical data for advertising and promotional purposes by Sponsor or its designee, whether or not in connection with Sweepstakes. Each entrant also agrees to be solely responsible for his/her own actions and for any liability related to his/her participation or any prize offered and to release, defend and hold Sponsor, its parent and affiliated companies, and prize provider and each of their respective related companies, officers, directors, employees, agents, insurers, successors and assignees, harmless from any liability for losses, damages, or injuries in connection with his/her participation in the Sweepstakes or award or use of a prize.
5. Eligibility
   Contest open to Canadian residents who have reached the age of 18 as of the first day of the month in which they have entered the Contest and who are not, employees or agents of Sponsor or of its affiliates, parent, subsidiaries, or its service agencies or independent contractors or immediate family of or are not residing in the same household as these employees. A Qualifying Electronic Entry participant may not be declared a winner unless the personal information listed on his/her valid provincial or federal issued identification matches exactly the personal information attached to their "Official Electronic Entry Form" appearing on the entry that is drawn. Contest is void where prohibited or restricted by law. The Contest is subject to all applicable federal, provincial, and local laws and regulations.
6. Prizes
   24 prizes will be available to be awarded for the Contest Period. Prizes will be awarded goods and not dollar value. Maximum value of prize is $130 (Cdn). The prize will be awarded in the form of Ricki's merchandise. Prizes must be claimed by November 30, 2011 or be forfeited.
7. Coat a Day Coat Donation
   Each daily contest winner has the option to provide the name of a women's shelter in or near the location of the winner's residence which they would like considered to be the recipient of the donation of one coat (max. value $130 Cdn.) in accordance with contest details for the duration of the Sweepstakes Period. Ricki's reserves the right to finalize each daily coat donation. Coat donations will be made in the name of Ricki's and not of the daily contest winner. Daily contest winners will not be provided a tax recipient for the value of any coat donation. Ricki's reserves the right to finalize and distribute coat donations until after the close of the Sweepstakes Period.
8. Odds
   The odds of winning a prize for each Contest draw depends on the total number of Qualifying Entries entered received for the applicable day.
9. No purchase or payment of any kind is necessary to enter or win this sweepstakes. A purchase will not improve your chance of winning.
10. Winner Notification/Prize Awards
    Winner shall be solely responsible for all federal, provincial or local taxes, fees and any and all other costs and expenses associated with the prize. No substitution of prize will be permitted except by Sponsor, which, at its discretion, may substitute a prize (or portion of a prize) of equal or greater value. Prize not transferable or exchangeable and cannot be redeemed for cash. The following process will be followed for the Contest draw. The selected participant will be notified of their selection via email by Ricki's – a Division of Comark Inc. In order to claim their prize, the selected participant will have to: (i) correctly answer unaided, a time-limited, mathematical skill-testing question to be administered by Sponsor during a pre-arranged, mutually convenient telephone call, (ii) complete and return the Sponsor's standard Declaration and Release (confirming compliance with the Contest rules and releasing Sponsor from any liability relating to the Contest) within 7 days from the time the prize notification package is emailed as having been sent by Sponsor. Within two business days of the Sponsor receiving the completed release form, the selected winner will receive an email confirming he/she has won and his/her Coat. The prize will be forfeited if the prize notification email is returned as non-deliverable, or if the selected participant does not correctly answer the skill-testing question, or if the signed Declaration and Release Form is not returned within 7 days from the time the prize notification email is been sent by Sponsor, or if the prize is not claimed by November 30, 2011. Should the originally drawn winner forfeit his/her prize, no subsequent draw(s) will be held.
11. Additional Terms
    By participating, entrants agree to a) these Official Contest Rules and the decisions of the Sponsor which shall be final in all respects; and b) release, discharge, indemnify and hold harmless Comark Inc. and each of its parent, subsidiaries, affiliates, officers, directors, administrators, employees, shareholders, agents and insurers, from any liability, claims, or damages, demands, actions, or causes of action whatsoever which they, their heirs, successors, assigns, executors, or administrators may now or hereafter have directly or indirectly against them or any of them in respect of or relating to the Contest and/or the acceptance or use, misuse, or possession of any prize; and c) the winner agrees to the Sponsor's and its designees' use of their names, voice, declarations relating to the Contest, likeness, photograph, city, province or territory of residence for advertising and publicity purposes without further compensation.
12. Limitation of Liability
    The Sponsor shall not be responsible for print or typographical errors in any Contest-related materials; for stolen, lost, late, misdirected, damaged, incomplete, illegible non purchase entries or, faulty electronic data transmission, equipment failure, or other failure occurring in connection with participation in this Contest; or for transactions that are posted late or incorrectly or are lost due to computer or electronic malfunction. The Sponsor reserves the right to cancel or modify all or any part of the Contest if for any reason the contest is not capable of running as planned, including fraud, technical failures or corruption, computer virus, tampering, unauthorized intervention, or any other cause beyond the control of Sponsor which in its opinion affects the administration, security, fairness, integrity or proper conduct of the Contest. Entries which are reproduced, fraudulent, illegible, altered, incomplete or tampered with, will be declared invalid.
13. Privacy Policy
    By entering this Contest, you consent to the Sponsor and its promotional agencies storing and using the personal information submitted through automatic entry for the purpose of administering the Contest in accordance with these Official Contest rules.
